Who sells, and who you contract with

The service is provided by Cavalier Venues Oy, a Finnish limited company (“we”) · Business ID 3649639-4 (Finnish Trade Register) · VAT ID FI36496394 · registered office Helsinki, Finland · postal address Lönnrotinkatu 40, 00180 Helsinki, Finland. By using Toilets Map you enter into an agreement with us on these terms. Contact: support@toilets.fi. This e-mail address is also our single point of contact under the EU Digital Services Act, for users and for authorities; you can write to us in English or Finnish.

Outside the United States and Canada, the web version is sold to you by Paddle.com Market Ltd, which acts as the merchant of record for the purchase: it charges the buyer, handles VAT, and handles refunds. The Paddle buyer terms also apply to the purchase.

Acceptance

Continued use of the service means you accept these terms. If you do not accept them, do not use the service.

What the service is

Toilets Map shows nearby public toilets on a map. Toilet data comes from OpenStreetMap, and on iOS also from Apple Maps; it is produced by third parties and is not always current. The iOS and Android apps are free to download on the App Store and Google Play, with an optional one-time Pro unlock. The separate browser version has been retired.

Misuse

You must not use the service in a way that

is unlawful or infringes anyone else's rights,
is fraudulent or constitutes spam,
infringes intellectual property rights, or
interferes with the security or operation of the service — including malware, probing for vulnerabilities, automated scraping, or load attacks.

Status reports

You can report a toilet's condition in the app by choosing from a fixed list, such as out of order or dirty; there is no free text. Other users see a summary of the reports for 48 hours. Reports are users' own observations, which we do not verify, and they never hide a toilet.

Do not send reports you know to be false. Automatic limits restrict how many reports can be sent in a short time. We do not check reports in advance, but we may hide or delete a report that breaks these terms, and block a device whose reports break them, after which its reports are not shown to others. A block lasts 90 days by default; a permanent block is always a separate decision. These decisions are made by a person.

To tell us about a report you consider unlawful or inappropriate, write to support@toilets.fi and include:

why you consider the report unlawful or inappropriate,
which toilet and which report the notice concerns: the toilet's shared link (the Share button on its card) or its toilet ID (the Send feedback link in the Report status view adds it to your message),
your name and e-mail address, and
a statement that you believe in good faith that the information in your notice is accurate and complete.

We confirm receipt, decide without undue delay and tell you the outcome; if you disagree, you can ask us to reconsider or take the matter to court. You can delete your own reports in the app's My data view.

Intellectual property

The service, its software, documentation and branding remain ours. A licence to use it transfers no ownership. Toilet data belongs to the OpenStreetMap contributors and is licensed under ODbL.

To answer searches without depending on public servers, we keep our own copy of that data, a derivative database under the ODbL. It is made this way: every OpenStreetMap element tagged amenity=toilets (except those tagged access=private or access=no), with its name, fee, wheelchair, changing_table, opening_hours, access, description, operator and check_date (or survey:date) tags, and for a way or a relation the centre of its bounding box. It is refreshed weekly from the QLever OpenStreetMap service of the University of Freiburg when that has newer data.

Service level

The service is provided as is. We do not guarantee uninterrupted or error-free operation, and we do not guarantee the accuracy of toilet data, opening hours or distances. The app never claims a toilet is definitely closed, because the source data goes stale.

Payment

In-app purchases in the iOS app are billed by Apple through the App Store, and in the Android app by Google through Google Play, under each store's terms. The web version is a one-time purchase, not a subscription: it is not billed again and there is nothing to cancel. Payment terms, taxes and billing for the web version are covered by the Paddle buyer terms. Refunds are described in our refund policy.

Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations.

Limitation of liability

We are not liable for indirect or consequential loss. Nothing in these terms limits mandatory consumer rights.

Governing law

Finnish law applies. As a consumer you may always bring proceedings in the courts of your place of residence, and you may refer a dispute to the Finnish Consumer Disputes Board.

The date this page was last updated is shown at the top. We announce material changes on this page.

Palvelun käytön jatkaminen tarkoittaa näiden ehtojen hyväksymistä. Jos et hyväksy ehtoja, älä käytä palvelua.

Mitä palvelu on

Vessakartta näyttää lähimmät yleiset vessat kartalla. Vessatiedot tulevat OpenStreetMapista ja iOS-sovelluksessa lisäksi Apple Mapsista; ne ovat kolmansien osapuolten tuottamia eivätkä aina ajan tasalla. iOS- ja Android-sovellukset ovat ilmaisia App Storessa ja Google Playssa, ja niihin voi ostaa kertaluonteisen Pro-avauksen. Erillinen selainversio on suljettu.

Väärinkäyttö

Palvelua ei saa käyttää siten, että

käyttö on lainvastaista tai loukkaa toisen oikeuksia,
se on petollista tai roskapostiluonteista,
se loukkaa immateriaalioikeuksia, tai
se häiritsee palvelun tietoturvaa tai toimintaa – esimerkiksi haittaohjelmat, tietoturva-aukkojen luotaaminen, automaattinen kaavinta tai kuormitushyökkäykset.

Tilailmoitukset

Sovelluksessa voi ilmoittaa vessan tilasta valitsemalla kiinteästä luettelosta, esimerkiksi rikki tai likainen; vapaata tekstiä ei ole. Muut käyttäjät näkevät ilmoituksista koosteen 48 tunnin ajan. Ilmoitukset ovat käyttäjien omia havaintoja, joita emme tarkista, eivätkä ne koskaan piilota vessaa.

Älä lähetä ilmoitusta, jonka tiedät vääräksi. Automaattiset rajat estävät lähettämästä paljon ilmoituksia lyhyessä ajassa. Emme tarkasta ilmoituksia etukäteen, mutta voimme piilottaa tai poistaa ilmoituksen, joka rikkoo näitä ehtoja, ja estää laitteen, jonka ilmoitukset rikkovat niitä, jolloin sen ilmoitukset eivät näy muille. Esto kestää oletuksena 90 vuorokautta; pysyvästä estosta päätämme aina erikseen. Päätökset tekee ihminen.

Lainvastaisesta tai asiattomasta ilmoituksesta voit kertoa osoitteeseen support@toilets.fi. Kirjoita viestiin

perustelu sille, miksi pidät ilmoitusta lainvastaisena tai asiattomana,
tieto siitä, mitä vessaa ja ilmoitusta asia koskee: vessan jakolinkki (vessan kortin Jaa-painike) tai vessan tunniste (Ilmoita tilasta -näkymän Lähetä palautetta -linkki lisää sen viestiin),
nimesi ja sähköpostiosoitteesi sekä
vakuutus siitä, että ilmoituksesi tiedot ovat vilpittömän käsityksesi mukaan oikeat ja täydelliset.

Vahvistamme vastaanoton, ratkaisemme asian viipymättä ja kerromme päätöksestä; jos olet eri mieltä, voit pyytää meitä harkitsemaan sitä uudelleen tai viedä asian tuomioistuimeen. Omat ilmoituksesi voit poistaa sovelluksen Omat tiedot -näkymässä.

Immateriaalioikeudet

Palvelu, sen ohjelmisto, dokumentaatio ja tunnukset ovat meidän omaisuuttamme. Käyttöoikeus ei siirrä omistusoikeutta. Vessatiedot ovat OpenStreetMapin tekijöiden omaisuutta ja lisensoitu ODbL-lisenssillä.

Jotta haut eivät riippuisi julkisista palvelimista, pidämme näistä tiedoista omaa kopiota, joka on ODbL-lisenssin tarkoittama johdettu tietokanta. Se tehdään näin: jokainen OpenStreetMapin kohde, jolla on tunniste amenity=toilets (lukuun ottamatta kohteita, joilla on access=private tai access=no), sen tunnisteet name, fee, wheelchair, changing_table, opening_hours, access, description, operator ja check_date (tai survey:date) sekä viivalle tai relaatiolle sen rajauslaatikon keskipiste. Kopio päivitetään viikoittain Freiburgin yliopiston QLever-palvelun OpenStreetMap-aineistosta, kun siinä on uudempaa tietoa.

Palvelutaso

Palvelu tarjotaan sellaisena kuin se on. Emme takaa, että se toimii keskeytyksettä tai virheettömästi, emmekä takaa vessatietojen, aukioloaikojen tai etäisyyksien oikeellisuutta. Sovellus ei koskaan väitä vessaa varmasti suljetuksi, koska lähdetiedot vanhenevat.

Maksut

Sovelluksen sisäiset ostot iOS-sovelluksessa laskuttaa Apple App Storen kautta ja Android-sovelluksessa Google Google Playn kautta kummankin kaupan ehdoilla. Verkkoversio on kertaosto, ei tilaus: siitä ei veloiteta uudelleen eikä sitä tarvitse irtisanoa. Verkkoversion maksuehtoihin, veroihin ja laskutukseen sovelletaan Paddlen ostajaehtoja. Palautuksista kerrotaan palautuskäytännössä.

Käytön keskeyttäminen

Voimme keskeyttää tai päättää pääsyn palveluun, jos näitä ehtoja rikotaan olennaisesti, maksu jää suorittamatta, käyttöön liittyy tietoturva- tai petosriski, tai rikkomukset toistuvat.

Vastuunrajoitus

Emme vastaa välillisistä vahingoista. Pakottavaa kuluttajansuojaa näillä ehdoilla ei rajoiteta.

Sovellettava laki

Sopimukseen sovelletaan Suomen lakia. Kuluttajana voit aina nostaa kanteen oman asuinpaikkasi tuomioistuimessa ja saattaa riidan kuluttajariitalautakunnan käsiteltäväksi.
